IMMIGRATION 'COMPROMISE' SELLS OUT OUR SOVEREIGNTY

The much-vaunted Senate “compromise” on immigration is a compromise alright: a compromise of our laws, a compromise of our sovereignty, and a compromise of the Second Amendment. That anyone in Washington believes this is a credible approach to solving our immigration crisis suggests just how out of touch our political elites really are.

The reality is that this bill will grant amnesty to virtually all of the 12 to 20 million illegal aliens in the country today. Supporters use very creative language to try and convince us that amnesty is not really amnesty, but when individuals who have entered the United States illegally are granted citizenship – regardless of the fees they are charged – what you have is amnesty.

What is seldom discussed in the immigration debate, unfortunately, is the incentives the US government provides for people to enter the United States illegally. As we know well, when the government subsidizes something we get more of it. The government provides a myriad of federal welfare benefits to those who come to the US illegally, including food stamps and free medical care. Is this a way to discourage people from coming to the US illegally?

Additionally, one of the most absurd incentives for people to come to the US illegally is the promise of instant US citizenship to anyone born on our soil. That is why when Congress returns next week I will be re-introducing my Constitutional amendment to deny automatic citizenship to individuals born on US soil to parents who are not US citizens or who do not owe permanent allegiance to the United States .

There are many other very troubling items buried deep in the Senate’s immigration compromise. The bill explicitly calls for an “acceleration” of the March 2005 agreement between the US president, the president of Mexico , and the prime minister of Canada , known as the “Security and Prosperity Partnership (SPP) of North America .” This somewhat secretive agreement – a treaty in all but name – aims to erase the borders between the United States , Canada , and Mexico and threatens our sovereignty and national security. The SPP was agreed by the president without the participation of Congress. It should be eliminated, not accelerated!

According to the pro-Second Amendment Gun Owners of America, the legislation also makes it easier to target gun dealers for prosecution. Even gun clubs could find themselves targeted under this immigration reform legislation.

Immigration reform should start with improving our border protection, yet it was reported last week that the federal government has approved the recruitment of 120 of our best trained Border Patrol agents to go to Iraq to train Iraqis how to better defend their borders! This comes at a time when the National Guard troops participating in Operation Jump Start are being removed from border protection duties in Arizona , New Mexico , and Texas and preparing to deploy to Iraq and Afghanistan ! It is an outrage and it will result in our borders being more vulnerable to illegal entry, including by terrorists.

I will continue to oppose any immigration bill that grants amnesty to illegals or undermines our liberty and sovereignty.

IN THE NAME OF PATRIOTISM (WHO ARE THE PATRIOTS?)

For some, patriotism is “the last refuge of a scoundrel.” For others, it means dissent against a government’s abuse of the people’s rights.

I have never met a politician in Washington, or any American for that matter, who chose to be called “unpatriotic.” Nor have I met anyone who did not believe he wholeheartedly supported our troops wherever they may be.

What I have heard all too frequently from various individuals is sharp accusations that because their political opponents disagree with them on the need for foreign military entanglements, they were “unpatriotic, un-American, evil doers deserving contempt.”

The original American patriots were those individuals brave enough to resist with force the oppressive power of King George. I accept the definition of patriotism as that effort to resist oppressive state power. The true patriot is motivated by a sense of responsibility, and out of self interest -- for himself, his family, and the future of his country -- to resist government abuse of power. He rejects the notion that patriotism means obedience to the state.

Resistance need not be violent, but the civil disobedience that might be required involves confrontation with the state and invites possible imprisonment.

Peaceful non-violent revolutions against tyranny have been every bit as successful as those involving military confrontation. Mahatma Gandhi and Dr. Martin Luther King, Jr. achieved great political successes by practicing non-violence, yet they themselves suffered physically at the hands of the state.

But whether the resistance against government tyrants is non-violent or physically violent, the effort to overthrow state oppression qualifies as true patriotism.

True patriotism today has gotten a bad name—at least from the government and the press. Those who now challenge the unconstitutional methods of imposing an income tax on us, or force us to use a monetary system designed to serve the rich at the expense of the poor, are routinely condemned. These American patriots are sadly looked down upon by many. They are never praised as champions of liberty as Gandhi and Martin Luther King Jr. have been.

Liberals, who withhold their taxes as a protest against war, are vilified as well—especially by conservative statists.

Unquestioned loyalty to the state is especially demanded in times of war. Lack of support for a war policy is said to be unpatriotic. Arguments against a particular policy that endorses a war once it’s started, are always said to be endangering the troops in the field. This, they blatantly claim, is unpatriotic and all dissent must stop. Yet it is dissent from government policies that defines the true patriot and champion of liberty.

It is conveniently ignored that the only authentic way to best support the troops is to keep them out of dangerous, undeclared, no-win wars that are politically inspired. Sending troops off to war for reasons that are not truly related to national security -- and for that matter may even damage our security -- is hardly a way to “patriotically” support the troops.

Who are the true patriots: those who conform or those who protest against wars without purpose? How can it be said that blind support for war, no matter how misdirected the policy, is the duty of the patriot?

Randolph Bourne said that “war is the health of the state.” With war, he argued, the state thrives. Those who believe in the powerful state see war as an opportunity. Those who mistrust the people and the market for solving problems have no trouble promoting a “war psychology” to justify the expansive role of the state.

This includes the role the federal government plays in our personal lives as well as in all our economic transactions. And certainly the neo-conservative belief that we have a moral obligation to spread American values worldwide, through force, justifies the conditions of war in order to rally support at home for the heavy hand of government. It is through this policy, it should surprise no one, that our liberties are undermined, the economy becomes overextended, and our involvement worldwide becomes prohibitive.

Out of fear of being labeled unpatriotic, most citizens become compliant and accept the argument that some loss of liberty is required to fight the war in order to remain safe. This is a bad trade-off in my estimation, especially when done in the name of patriotism.

Loyalty to the state and to autocratic leaders is substituted for true patriotism—that is, a willingness to challenge the state and defend the country, the people, and the culture. The more difficult the times, the stronger the admonition becomes that the leaders be not criticized.

Because the crisis atmosphere of war supports the growth of the state, any problem invites an answer by declaring “war” -- even on social and economic issues. This elicits patriotism in support of various government solutions while enhancing the power of the state. Faith in government coercion and a lack of understanding of how free societies operate, encourages big government liberals and big government conservatives to manufacture a war psychology to demand political loyalty for domestic policy just as is required in foreign affairs. The long term cost in dollars spent and liberties lost is neglected as immediate needs are emphasized.

It is for this reason that we have multiple perpetual wars going on simultaneously. Thus the war on drugs, against gun ownership, poverty, illiteracy, and terrorism, as well as our foreign military entanglements, are endless.

All this effort promotes the growth of statism at the expense of liberty. A government designed for a free society should do the opposite: prevent the growth of statism and preserve liberty. Once a war of any sort is declared, the message is sent out not to object or you will be declared unpatriotic. Yet, we must not forget that the true patriot is the one who protests in spite of the consequences, condemnation or ostracism, or even imprisonment that may result.

Non-violent protesters of the tax code are frequently imprisoned—whether they are protesting the code’s unconstitutionality or the war that the tax revenues are funding.

Resisters to the military draft, or even to selective service registration, are threatened and imprisoned for challenging this threat to liberty.

Statism depends on the idea that the government owns us and citizens must obey. Confiscating the fruits of our labor through the income tax is crucial to the health of the state. The draft, or even the mere existence of the selective service, emphasizes that we will march off to war at the state’s pleasure. A free society rejects all notions of involuntary servitude whether by draft or the confiscation of the fruits of our labor through the personal income tax.

A more sophisticated and less well known technique for enhancing the state is the manipulation and transfer of wealth through the fiat monetary system operated by the secretive Federal Reserve. Protestors against this unconstitutional system of paper money are considered unpatriotic criminals and at times are imprisoned for their beliefs. The fact that, according to the Constitution, only gold and silver are legal tender and paper money is outlawed, matters little. The principle of patriotism is turned on its head.

Whether it’s with regard to the defense of welfare spending at home, confiscatory income tax, an immoral monetary system, or support for a war fought under false pretense without a legal declaration, the defenders of liberty and the Constitution are portrayed as unpatriotic while those who support these programs are seen as the patriots. If there’s a “war” going on, supporting the state’s efforts to win the war is expected at all costs. No dissent!

The real problem is that those who love the state too often advocate policies that lead to military action. At home they are quite willing to produce a crisis atmosphere and claim a war is needed to solve the problem. Under these conditions the people are more willing to bear the burden of paying for the war, and to carelessly sacrifice liberties which they are told is necessary.

The last six years have been quite beneficial to the “health of the state,” which comes at the expense of personal liberty. Every enhanced unconstitutional power of the state can only be achieved at the expense of individual liberty.

Even though every war in which we have been engaged civil liberties have suffered, some have been restored after the war ended, but never completely. This has resulted in a steady erosion of our liberties over the past 200 years. Our government was originally designed to protect our liberties, but it has now instead become the usurper of those liberties.

We currently live in the most difficult of times for guarding against an expanding central government with a steady erosion of our freedoms.

We are continually being reminded that “9/11 has changed everything.” Unfortunately, the policy that needed most to be changed—that is our policy of foreign interventionism—has only been expanded. There is no pretense any longer that a policy of humility in foreign affairs, without being the world’s policeman and engaging in nation building, is worthy of consideration. We now live in a post 9/11 America where our government is going to make us safe no matter what it takes. We’re expected to grin and bear it and adjust to every loss of our liberties in the name of patriotism and security.

Though the majority of Americans initially welcomed this declared effort to make us safe, and were willing to sacrifice for the cause, more and more Americans are now becoming concerned about civil liberties being needlessly and dangerously sacrificed. The problem is that the Iraq war continues to drag on and a real danger of its spreading exists. There’s no evidence that a truce will soon be signed in Iraq , or in the war on terror or drugs. Victory is not even definable. If Congress is incapable of declaring an official war, it’s impossible to know when it will end. We have been fully forewarned that the world conflict in which we’re now engaged will last a long, long time.

The war mentality, and the pervasive fear of an unidentified enemy, allows for a steady erosion of our liberties, and with this our respect for self reliance and confidence is lost. Just think of the self sacrifice and the humiliation we go through at the airport screening process on a routine basis. Though there’s no scientific evidence of any likelihood of liquids and gels being mixed on an airplane to make a bomb, billions of dollars are wasted throwing away toothpaste and hairspray and searching old women in wheelchairs.

Our enemies say boo, and we jump, we panic, and then we punish ourselves. We’re worse than a child being afraid of the dark. But in a way, the fear of indefinable terrorism is based on our inability to admit the truth about why there is a desire by a small number of angry radical Islamists to kill Americans. It’s certainly not because they are jealous of our wealth and freedoms.

We fail to realize that the extremists, willing to sacrifice their own lives to kill their enemies, do so out of a sense of weakness and desperation over real and perceived attacks on their way of life, their religion, their country and their natural resources. Without the conventional diplomatic or military means to retaliate against these attacks, and an unwillingness of their own government to address the issue, they resort to the desperation tactic of suicide terrorism. Their anger toward their own governments, which they believe are co-conspirators with the American government, is equal to or greater than that directed toward us. These errors in judgment in understanding the motive of the enemy and the constant fear that is generated have brought us to this crisis where our civil liberties and privacy are being steadily eroded in the name of preserving national security. We may be the economic and military giant of the world, but the effort to stop this war on our liberties here at home in the name of patriotism, is being lost.

The erosion of our personal liberties started long before 9/11, but 9/11 accelerated the process. There are many things that motivate those who pursue this course—both well-intentioned and malevolent. But it would not happen if the people remained vigilant, understood the importance of individual rights, and were unpersuaded that a need for security justifies the sacrifice of liberty—even if it’s just now and then.

The true patriot challenges the state when the state embarks on enhancing its power at the expense of the individual. Without a better understanding and a greater determination to reign in the state, the rights of Americans that resulted from the revolutionary break from the British and the writing of the Constitution, will disappear.

The record since September 11, 2001, is dismal. Respect for liberty has rapidly deteriorated.

Many of the new laws passed after 9/11 had in fact been proposed long before that attack. The political atmosphere after that attack simply made it more possible to pass such legislation. The fear generated by 9/11 became an opportunity for those seeking to promote the power of the state domestically, just as it served to falsely justify the long planned-for invasion of Iraq .

The war mentality was generated by the Iraq war in combination with the constant drum beat of fear at home. Al Qaeda and Osama bin Laden, who is now likely residing in Pakistan , our supposed ally, are ignored, as our troops fight and die in Iraq and are made easier targets for the terrorists in their backyard. While our leaders constantly use the mess we created to further justify the erosion of our constitutional rights here at home, we forget about our own borders and support the inexorable move toward global government—hardly a good plan for America.

The accelerated attacks on liberty started quickly after 9/11. Within weeks the Patriot Act was overwhelmingly passed by Congress. Though the final version was unavailable up to a few hours before the vote—no Member had sufficient time to read or understand it—political fear of “not doing something,” even something harmful, drove Members of Congress to not question the contents and just vote for it. A little less freedom for a little more perceived safety was considered a fair tradeoff—and the majority of Americans applauded.

The Patriot Act, though, severely eroded the system of checks and balances by giving the government the power to spy on law abiding citizens without judicial supervision. The several provisions that undermine the liberties of all Americans include: sneak and peak searches; a broadened and more vague definition of domestic terrorism; allowing the FBI access to libraries and bookstore records without search warrants or probable cause; easier FBI initiation of wiretaps and searches, as well as roving wiretaps; easier access to information on American citizens’ use of the internet; and easier access to e-mail and financial records of all American citizens.

The attack on privacy has not relented over the past six years. The Military Commissions Act is a particularly egregious piece of legislation and, if not repealed, will change America for the worse as the powers unconstitutionally granted to the Executive Branch are used and abused.

This act grants excessive authority to use secretive military commissions outside of places where active hostilities are going on. The Military Commissions Act permits torture, arbitrary detention of American citizens as unlawful enemy combatants at the full discretion of the president and without the right of Habeas Corpus, and warrantless searches by the NSA (National Security Agency). It also gives to the president the power to imprison individuals based on secret testimony.

Since 9/11, Presidential signing statements designating portions of legislation that the President does not intend to follow, though not legal under the Constitution, have enormously multiplied. Unconstitutional Executive Orders are numerous and mischievous and need to be curtailed.

Extraordinary rendition to secret prisons around the world has been widely engaged in, though obviously extra-legal.

A growing concern in the post 9/11 environment is the federal government’s lists of potential terrorists based on secret evidence. Mistakes are made and sometimes it is virtually impossible to get one’s name removed, even though the accused is totally innocent of any wrongdoing.

A national ID card is now in the process of being implemented. It’s called the Real ID card and it’s tied to our Social Security numbers and our state driver’s license. If Real ID is not stopped it will become a national driver’s license/ID for all America .

Some of the least noticed and least discussed changes in the law were the changes made to the Insurrection Act of 1807 and to Posse Comitatus by the Defense Authorization Act of 2007.

These changes pose a threat to the survival of our republic by giving the president the power to declare martial law for as little reason as to restore “public order.” The 1807 Act severely restricted the president in his use of the military within the United States borders, and the Posse Comitatus Act of 1878 strengthened these restrictions with strict oversight by Congress. The new law allows the president to circumvent the restrictions of both laws. The Insurrection Act has now become the “Enforcement of the Laws to Restore Public Order Act”. This is hardly a title that suggests that the authors cared about or understood the nature of a constitutional republic.

Now, martial law can be declared not just for “insurrection” but also for “natural disasters, public health reasons, terrorist attacks or incidents” or for the vague reason called “other conditions.” The President can call up the National Guard without Congressional approval or the governors’ approval and even send these state guard troops into other states. The American republic is in remnant status. The stage is set for our country eventually devolving into a military dictatorship and few seem to care.

These precedent setting changes in the law are extremely dangerous and will change American jurisprudence forever if not reversed. The beneficial results of our revolt against the king’s abuses are about to be eliminated and few Members of Congress and few Americans are aware of the seriousness of the situation. Complacency and fear drive our legislation without any serious objection by our elected leaders.

Sadly, those few who do object to this self evident trend away from personal liberty and empire building overseas are portrayed as unpatriotic and uncaring.

Though welfare and socialism always fails, opponents of them are said to lack compassion. Though opposition to totally unnecessary war should be the only moral position, the rhetoric is twisted to claim that patriots who oppose the war are not “supporting the troops”. The cliché “support the troops” is incessantly used as a substitute for the unacceptable notion of “supporting the policy” no matter how flawed it may be. Unsound policy can never help the troops. Keeping the troops out of harm’s way and out of wars unrelated to our national security is the only real way of protecting the troops. With this understanding, just who can claim the title of “patriot”?

Before the war in the Middle East spreads and becomes a world conflict, for which we’ll be held responsible, or the liberties of all Americans become so suppressed we can no longer resist, much has to be done. Time is short but our course of action should be clear. Resistance to illegal and unconstitutional usurpation of our rights is required. Each of us must choose which course of action we should take—education, conventional political action, or even peaceful civil disobedience, to bring about the necessary changes.

But let it not be said that we did nothing.

Let not those who love the power of the welfare/warfare state label the dissenters of authoritarianism as unpatriotic or uncaring. Patriotism is more closely linked to dissent than it is to conformity and a blind desire for safety and security. Understanding the magnificent rewards of a free society makes us unbashful in its promotion, fully realizing that maximum wealth is created and the greatest chance for peace comes from a society respectful of individual liberty.

STATEMENT ON IMMIGRATION AGREEMENT

I remain very skeptical about the idea of so-called comprehensive immigration reform and the Senate compromise now being discussed. I will oppose any legislation that in any way, shape, or form grants amnesty to the millions of people who are in this country illegally. I have advocated that we should tighten citizenship requirements, and I still believe that. Moreover, the argument that we need to start a guest worker program is simply a shell game, we already have a generous guest worker program that the American people support. Support for such a program should not be used as a back door to amnesty for illegals.

STATEMENT ON CHINESE CURRENCY

The imbalances in international trade, and in particular trade between China and the United States, have prompted many to demand a realignment of the Chinese yuan and the American dollar. Since we are running a huge trade deficit with China the call now is for a stronger yuan and a weaker dollar. This trade imbalance problem will not be solved so easily.

If a stronger yuan is implemented, increased exports to China from the US may or may not result. The weaker dollar will lead to higher US prices and crowd out the hoped-for benefits of a realignment of the two currencies.

One thing certain is that the immediate impact would be higher prices for consumer goods for middle class Americans. In many ways a weaker dollar would act as an import tax just as if it were a tariff. Both are considered protectionist in nature.

The fact that the Chinese keep their currency artificially weak is a benefit to American consumers and long term is inflationary for the Chinese.

This deep and legitimate concern for the trade imbalance between China and the US will fall short if the issue of fluctuating, world-wide fiat currencies, is not addressed.

The fact that the US dollar is the principal reserve currency of the world gives us a benefit that others do not enjoy. It allows us to export paper dollars and import goods manufactured in countries with cheap labor. It also allows us to finance the welfare/warfare state with cheap loans from China and Japan. It's a good deal for us but according to economic law must come to an end, and the end will be messy for the US consumer and for world trade.

The current system can only last as long as the trust in the dollar is maintained and foreigners are willing to accept them as if they had real value.

Ironically, the most serious problem we face is a sharply weakening dollar, in danger of collapse, and yet many are now asking for a policy, dealing with the Chinese, that would accelerate the dollar's decline. And yet we're told that we maintain a strong dollar policy.

Financing deficits with monetary inflation is in itself a weak dollar policy in the long term. Trust in our currency due to our economic and military strength artificially props up the dollar on international exchange markets. Since these benefits come not from production or sound money policies, they only contribute to the instability and imbalances in international trade.

Neither tariffs nor forced devaluations can solve the problem.

Our current account deficit and huge foreign indebtedness is a reflection of the world monetary system of fiat money. The longer the trade imbalances last, the more difficult the adjustment will be. The market will eventually force these adjustments on us.

Eventually it will be necessary to consider commodity-based money to solve the trade imbalances that concern so many here in the Congress.

INTRODUCING THE HEALTH FREEDOM PROTECTION ACT

Madam Speaker, I rise to introduce the Health Freedom Protection Act. This bill restores the First Amendment rights of consumers to receive truthful information regarding the benefits of foods and dietary supplements by codifying the First Amendment standards used by federal courts to strike down the Food and Drug Administration (FDA) efforts to censor truthful health claims. The Health Freedom Protection Act also stops the Federal Trade Commissions (FTC) from censoring truthful health care claims.

The American people have made it clear they do not want the federal government to interfere with their access to dietary supplements, yet the FDA and the FTC continue to engage in heavy-handed attempts to restrict such access. The FDA continues to frustrate consumers’ efforts to learn how they can improve their health even after Congress, responding to a record number of constituents’ comments, passed the Dietary Supplement and Health and Education Act of 1994 (DSHEA). FDA bureaucrats are so determined to frustrate consumers’ access to truthful information that they are even evading their duty to comply with four federal court decisions vindicating consumers’ First Amendment rights to discover the health benefits of foods and dietary supplements.

FDA bureaucrats have even refused to abide by the DSHEA section allowing the public to have access to scientific articles and publications regarding the role of nutrients in protecting against diseases by claiming that every article concerning this topic is evidence of intent to sell a drug.

Because of the FDA’s censorship of truthful health claims, millions of Americans may suffer with diseases and other health care problems they may have avoided by using dietary supplements. For example, the FDA prohibited consumers from learning how folic acid reduces the risk of neural tube defects for four years after the Centers for Disease Control and Prevention recommended every woman of childbearing age take folic acid supplements to reduce neural tube defects. This FDA action contributed to an estimated 10,000 cases of preventable neutral tube defects!

The FDA also continues to prohibit consumers from learning about the scientific evidence that glucosamine and chondroitin sulfate are effective in the treatment of osteoarthritis; that omega-3 fatty acids may reduce the risk of sudden death heart attack; and that calcium may reduce the risk of bone fractures.

The Health Freedom Protection Act will force the FDA to at last comply with the commands of Congress, the First Amendment, and the American people by codifying the First Amendment standards adopted by the federal courts. Specifically, the Health Freedom Protection Act stops the FDA from censoring truthful claims about the curative, mitigative, or preventative effects of dietary supplements, and adopts the federal court’s suggested use of disclaimers as an alternative to censorship. The Health Freedom Protection Act also stops the FDA from prohibiting the distribution of scientific articles and publications regarding the role of nutrients in protecting against disease.

This legislation also addresses the FTC’s violations of the First Amendment. Under traditional First Amendment jurisprudence, the federal government bears the burden of proving an advertising statement false before censoring that statement. However, the FTC has reversed the standard in the case of dietary supplements by requiring supplement manufactures to satisfy an unobtainable standard of proof that their statement is true. The FTC’s standards are blocking innovation in the marketplace.

The Health Freedom Protection Act requires the government bear the burden of proving that speech could be censored. This is how it should be in a free, dynamic society. The bill also requires that the FTC warn parties that their advertising is false and give them a chance to correct their mistakes.

Madam Speaker, if we are serious about putting people in charge of their health care, then shouldn’t we stop federal bureaucrats from preventing Americans from learning about simple ways to improve their health. I therefore call on my colleagues to stand up for good health care and the First Amendment by cosponsoring the Health Freedom Protection Act.

FIXING WHAT'S WRONG WITH IRAQ

Many of my colleagues, faced with the reality that the war in Iraq is not going well, line up to place all the blame on the president. The president “mismanaged” the war, they say. “It’s all the president’s fault,” they claim. In reality, much of the blame should rest with Congress, which shirked its constitutional duty to declare war and instead told the president to decide for himself whether or not to go to war.

More than four years into that war, Congress continues to avoid its constitutional responsibility to exercise policy oversight, particularly considering the fact that the original authorization no longer reflects the reality on the ground in Iraq .

According to the original authorization (Public Law 107-243) passed in late 2002, the president was authorized to use military force against Iraq to achieve the following two specific objectives only:

“(1) defend the national security of the United States against the continuing threat posed by Iraq ; and
(2) enforce all relevant United Nations Security Council resolutions regarding Iraq ”

I was highly critical of the resolution at the time, because I don’t think the United States should ever go to war to enforce United Nations resolutions. I was also skeptical of the claim that Iraq posed a “continuing threat” to the United States.

As it turned out, Iraq had no weapons of mass destruction, no al-Qaeda activity, and no ability to attack the United States . Regardless of this, however, when we look at the original authorization for the use of force it is clearly obvious that our military has met both objectives. Our military very quickly removed the regime of Saddam Hussein, against whom the United Nations resolutions were targeted. A government approved by the United States has been elected in post-Saddam Iraq, fulfilling the first objective of the authorization.

With both objectives of the original authorization completely satisfied, what is the legal ground for our continued involvement in Iraq ? Why has Congress not stepped up to the plate and revisited the original authorization?

This week I plan to introduce legislation that will add a sunset clause to the original authorization (Public Law 107-243) six months after passage. This is designed to give Congress ample time between passage and enactment to craft another authorization or to update the existing one. With the original objectives fulfilled, Congress has a legal obligation to do so. Congress also has a moral obligation to our troops to provide relevant and coherent policy objectives in Iraq.

Unlike other proposals, this bill does not criticize the president’s handling of the war. This bill does not cut off funds for the troops. This bill does not set a timetable for withdrawal. Instead, it recognizes that our military has achieved the objectives as they were spelled out in law and demands that Congress live up to its constitutional obligation to provide oversight. I am hopeful that this legislation will enjoy broad support among those who favor continuing or expanding the war as well as those who favor ending the war. We need to consider anew the authority for Iraq and we need to do it sooner rather than later.

SECURITY, WASHINGTON-STYLE

Congress voted this past week to authorize nearly $40 billion for the Homeland Security Department, but the result will likely continue to be more bureaucracy and less security for Americans.

Five years into this new Department, Congress still cannot agree on how to handle the mega-bureaucracy it created, which means there has been no effective oversight of the department. While Congress remains in disarray over how to fund and oversee the department, we can only wonder whether we are more vulnerable than we were before Homeland Security was created.

I was opposed to the creation of a new Homeland Security Department from the beginning. Only in Washington would anyone call the creation of an additional layer of bureaucracy on top of already bloated bureaucracies “streamlining.” Only in Washington would anyone believe that a bigger, more centralized federal government means more efficiency.

When Congress voted to create the Homeland Security Department, I strongly urged that -- at the least -- FEMA and the Coast Guard should remain independent entities outside the Department. Our Coast Guard has an important mission -- to protect us from external threats -- and in my view it is dangerous to experiment with re-arranging the deck chairs when the United States is vulnerable to attack. As I said at the time, “the Coast Guard and its mission are very important to the Texas Gulf coast, and I don’t want that mission relegated to the back burner in a huge bureaucracy."

Likewise with FEMA. At the time of the creation of the Department of Homeland Security, I wrote “we risk seeing FEMA become less responsive as part of DHS. FEMA needs to be a flexible, locally focused, hands-on agency that helps people quickly after a disaster.” Unfortunately and tragically, we all know very well what happened in 2005 with Hurricanes Katrina and Rita. We know that FEMA’s handing of the disaster did in many cases more harm than good. FEMA was so disorganized and incompetent in its management of the 2005 hurricanes that one can only wonder how much the internal disarray in the Department of Homeland Security may have contributed to that mismanagement.

Folding responsibility for defending our land borders into the Department of Homeland Security was also a bad idea, as we have come to see. The test is simple: We just ask ourselves whether our immigration enforcement has gotten better or worse since functions were transferred into this super bureaucracy. Are our borders being more effectively defended against those who would enter our country illegally? I don’t think so.

Are we better off with an enormous conglomerate of government agencies that purports to keep us safe? Certainly we are spending more money and getting less for it with the Department of Homeland Security. Perhaps now that the rush to expand government in response to the attacks of 9/11 is over, we can take a good look at what is working, what is making us safer, and what is not. If so, we will likely conclude that the Department of Homeland Security is too costly, too bloated, and too bureaucratic. Hopefully then we will refocus our efforts on an approach that doesn’t see more federal bureaucracy in Washington as the best way to secure the rest of the nation.

RON PAUL AND THE MSNBC DEBATE

During the recent MSNBC Republican presidential debate, Republican presidential candidate Ron Paul made three profound points on U.S. foreign policy that the American people would be wise to heed. Needless to say, Paul’s three points, being libertarian in nature, aren’t likely to be favorably received within the Washington, D.C., establishment, especially among lobbyists for the military-industrial complex. Perhaps that is why, despite Paul's first-place finish in post-debate polls conducted by MSNBC, ABCNews.com, and C-SPAN — or maybe because of those results — the Washington Post used its lead editorial on Tuesday to specifically question Paul’s participation in the rest of the Republican presidential debates.

The first point was that the Iraq War violated the traditional American policy of foreign nonintervention that characterized our nation through most of the first 125 years of its existence. What Paul was referring to was summed up in the speech that John Quincy Adams delivered to Congress on the 50th anniversary of the Fourth of July: that America does not “go abroad in search of monsters to destroy,” and that, if America were ever to embrace such a policy, the “fundamental maxims of her policy would insensibly change from liberty to force” and she would become “the dictatress of the world.”

What better example of the validity of Adams’s admonition than President Bush’s war on Iraq? On his own initiative and without the constitutionally required congressional declaration of war, President Bush sent the nation into war against Iraq in an attempt to destroy the monster known as Saddam Hussein. In the process, the United States has become a brutal occupying power that has brought not liberty but rather death, destruction, torture, mayhem, and civil war to the Iraqi people. Moreover, with its long-time foreign policy of embargoes, sanctions, regime-change operations, kidnappings, rendition, torture, detentions, invasions, occupations, and overseas prisons, in the eyes of many people around the world, the United States has indeed become “the dictatress of the world.”

The second point that Paul mentioned was with respect to the declaration-of-war requirement in the Constitution. Recognizing the historical propensity of rulers, especially ones with standing armies at their disposal, to start wars on their own initiative, the Framers separated the power to wage war from the power to declare war. The idea was that if the president failed to secure a declaration of war from Congress, he would be precluded from waging the war, no matter how vital he thought it was.

Unfortunately, that constitutional requirement has long been ignored despite the fact that the Constitution has never been amended to eliminate it. It goes without saying that if President Bush had gone to Congress to seek a declaration of war against Iraq, it is entirely possible that Congress would have pierced through his WMD rationale for the war and denied him a declaration of war, thereby enabling the nation to avoid the quagmire in which it now finds itself.

The third point that Paul made was with respect to government spending. Asked whether he supported a repeal of the income tax, he did not hesitate to respond in the affirmative, but he did not leave it there. He pointed out that it is impossible to reduce or eliminate income taxes without reducing or eliminating the programs that the tax revenues are funding, e.g., the U.S. government’s pro-empire, interventionist foreign policy, of which the invasion and occupation of Iraq have been just one part. Many years ago, Nobel Prize-winning economist Milton Friedman made the same point when he stated that the true cost of government was not the tax burden but rather the level of government spending.

A related point that Paul emphasized during the debate was the insidious tax known as inflation, a process by which public officials simply print the money to fund their programs, and which ultimately is reflected in rising prices. The beauty of inflation, from the standpoint of public officials, is that most people don’t realize that federal spending is the culprit behind rising prices. Thus, when the price of commodities such as oil and gas begin to rise, people just assume that it is because of greedy people in the private sector rather than because of federal spending on the rebuilding of Iraq and other federal programs.

The three points that Ron Paul made in the MSNBC debate hold a key to the liberty and well-being of our nation. That is also why our Founding Fathers considered them so vitally important.

RON PAUL WON THE DEBATE

No less than ten Republican hopefuls in the 2008 White House race participated in the first national GOP debate last Thursday, May 3. Even before the 90-minute debate had concluded, media pundits were declaring that former Massachusetts Governor Mitt Romney had won.

Even my friend, MSNBC's Joe Scarborough wrote, "During the debate I was flooded by e-mails from Republican activists and voters who told me Romney was dominating the debate." Scarborough went on to say, "Among those Red State Republicans (who will elect their party's next nominee), Mitt Romney won while McCain and Giuliani failed to meet expectations."

As with most political pundits, the entire focus of the debate centered on only three contenders: Arizona Senator John McCain, former New York City Mayor Rudy Giuliani, and Romney. In fact, in his post-debate summary, Scarborough's only reference to anyone other than these three names was a fleeting mention of the "Sam Brownbacks of the world." Yet, when one looks at MSNBC's own poll, a much different picture emerges. According to this poll, there was a clear winner alright, but his name was not McCain, Giuliani, or Romney. It was Texas Congressman Ron Paul.

The after-debate poll numbers for six of the "lesser" contenders were almost identical to the before-debate numbers. Almost identical. I'm speaking of Sam Brownback, Jim Gilmore, Mike Huckabee, Duncan Hunter, Tom Tancredo, and Tommy Thompson. It is safe to say, that none of these men obtained any significant support as a result of their debate performance. However, the same is not true for Ron Paul.
Before the debate, Paul's polling numbers had a negative rating of 47%. His neutral number was 44%, and his positive number was a paltry 9%.

Compare those numbers with those of the three media favorites, McCain, Giuliani, and Romney.

John McCain's pre-debate polling numbers included a negative rating of 40%. His neutral number was 29%, and his positive rating was 31%. Rudy Giuliani's pre-debate poll numbers included a negative rating of 34%, a neutral rating of 25%, and a positive rating of 41%. Mitt Romney's pre-debate negative number stood at 41%. His neutral number was 31%, and his positive number stood at 28%.

Obvious to just about anyone is that Rudy Giuliani took a commanding lead into the first GOP debate. His positive number eclipsed his closest rival by more than ten percentage points. However, everything changed immediately following the debate. Giuliani's positive number fell from 41% to a pitiful 24%. His negative number rose from 34% to 42%. And his neutral number rose from 25% to 34%. Clearly, Rudy Giuliani lost a lot of support in that first debate.

What about John McCain? Once again, his debate performance did not help his campaign. In this regard, Joe Scarborough has it right.

McCain's positive rating fell from a pre-debate high of 31% to a post-debate low of 19%. His neutral rating jumped from 29% to 37%.

Remember, media pundits seem to agree that Mitt Romney was the big debate winner. So, how do his numbers stack up?

Romney's post-debate positive rating DROPPED from a pre-debate high of 28% to 27%. His negative number also fell slightly from 41% to 37%. And Romney's neutral number rose from 31% to 36%. I ask you, Do those numbers reflect victory? I think not.

Compare the numbers of McCain, Giuliani, and Romney to those of Ron Paul's. Remember, before the debate, Paul scored a dismal 9% positive score. But after the debate, Paul's positive score skyrocketed to an astounding 38%. In other words, Ron Paul's positive number is eleven percentage points higher than his closest rival. Paul's negative number went from a pre-debate high of 47% to a post-debate low of 26%. His neutral number also dropped significantly from 44% to 36%.

Without question or reservation, Ron Paul was the clear and obvious winner of the first GOP debate, at least according to the more than eighty-four thousand respondents (at the time of this writing) who took the MSNBC online poll.

Which leads to another question: Are the media elite watching the same debate that the rest of us are watching or are they looking at something else? I think they are looking at something else. And that something else is money.

They see only the GOP's "Big Three" as having the potential to raise $50 million-plus for their respective presidential campaigns. That means, in their minds, all others are also-rans who have no chance to win and are therefore ignored. And let's face it folks, when it comes to Washington politics, there are only three considerations that even register with big-media: money, money, and money.

However, make no mistake about it: Ron Paul clearly and convincingly won the first GOP debate. It would be nice if someone in the mainstream media would acknowledge that fact.

In addition, someone in the mainstream media should ask why Ron Paul did so well in post-debate polling, because I predict that Paul's upcoming performance in South Carolina on May 15 will be equally spectacular. He may even emerge from that debate as a serious challenger for the nomination. I personally hope he does.

Ron Paul is the only candidate on the Republican ticket who would seriously challenge the status quo of the neocons currently running our country into the ground. He has a voting record unlike anyone in Congress.

As has been reported by many, Ron Paul has never voted to raise taxes, has never voted for an unbalanced budget, has never voted for a federal registration on gun ownership, has never voted to raise congressional pay, has never taken a government-paid junket, and has never voted to increase the power of the executive branch of the federal government. Furthermore, he voted against the Patriot Act and was one of only a handful of congressmen that voted against the Iraq War.

Furthermore, it was Ron Paul who introduced the Sanctity of Human Life bill in Congress, which, had it passed, would have granted federal protection to every unborn child and would have nullified Roe v Wade. In addition, Ron Paul is one of the biggest opponents to Bush's push to integrate the United States into a trilateral North American Community. Ron Paul also supports ending the Income Tax and dismantling the Internal Revenue Service. In short, Ron Paul is big-government's worst nightmare.

All of the above became obvious to voters during the six-plus minutes that Ron Paul had the national spotlight. That is why his poll numbers surged following the debate. Imagine what could happen if Paul is given more time to articulate his constitutionalist agenda. He could win more than the debate--he could win the election.

UNCONSTITUTIONAL LEGISLATION THREATENS FREEDOM

Last week, the House of Representatives acted with disdain for the Constitution and individual liberty by passing HR 1592, a bill creating new federal programs to combat so-called “hate crimes.” The legislation defines a hate crime as an act of violence committed against an individual because of the victim’s race, religion, national origin, gender, sexual orientation, gender identity, or disability. Federal hate crime laws violate the Tenth Amendment’s limitations on federal power. Hate crime laws may also violate the First Amendment guaranteed freedom of speech and religion by criminalizing speech federal bureaucrats define as “hateful.”

There is no evidence that local governments are failing to apprehend and prosecute criminals motivated by prejudice, in comparison to the apprehension and conviction rates of other crimes. Therefore, new hate crime laws will not significantly reduce crime. Instead of increasing the effectiveness of law enforcement, hate crime laws undermine equal justice under the law by requiring law enforcement and judicial system officers to give priority to investigating and prosecuting hate crimes. Of course, all decent people should condemn criminal acts motivated by prejudice. But why should an assault victim be treated by the legal system as a second-class citizen because his assailant was motivated by greed instead of hate?

HR 1592, like all hate crime laws, imposes a longer sentence on a criminal motivated by hate than on someone who commits the same crime with a different motivation. Increasing sentences because of motivation goes beyond criminalizing acts; it makes it a crime to think certain thoughts. Criminalizing even the vilest hateful thoughts--as opposed to willful criminal acts--is inconsistent with a free society.

HR 1592 could lead to federal censorship of religious or political speech on the grounds that the speech incites hate. Hate crime laws have been used to silence free speech and even the free exercise of religion. For example, a Pennsylvania hate crime law has been used to prosecute peaceful religious demonstrators on the grounds that their public Bible readings could incite violence. One of HR 1592’s supporters admitted that this legislation could allow the government to silence a preacher if one of the preacher’s parishioners commits a hate crime. More evidence that hate crime laws lead to censorship came recently when one member of Congress suggested that the Federal Communications Commission ban hate speech from the airwaves.

Hate crime laws not only violate the First Amendment, they also violate the Tenth Amendment. Under the United States Constitution, there are only three federal crimes: piracy, treason, and counterfeiting. All other criminal matters are left to the individual states. Any federal legislation dealing with criminal matters not related to these three issues usurps state authority over criminal law and takes a step toward turning the states into mere administrative units of the federal government.

Because federal hate crime laws criminalize thoughts, they are incompatible with a free society. Fortunately, President Bush has pledged to veto HR 1592. Of course, I would vote to uphold the president’s veto.

GETTING IRAQ WAR FUNDING WRONG AGAIN

This week, Congress finalized the controversial $124 billion Iraq emergency supplemental spending bill, with the House and Senate both voting in favor of final passage. The majority of my Republican colleagues and I voted against this measure, and the president has vowed to veto the legislation.

In this final version, the House leadership retained billions of dollars in pork meant to attract skeptical votes, retained a watered-down version of the problematic “benchmarks” that seek to micromanage the war effort, and continued to play politics with the funding of critical veterans medical and other assistance. In other words, this final version was even worse than the original in almost all respects.

As I wrote when this measure first came before the House, we have to make a clear distinction between the Constitutional authority of Congress to make foreign policy, and the Constitutional authority of the president, as commander in chief, to direct the management of any military operation. We do no favor to the troops by micromanaging the war from Capitol Hill while continuing to fund it beyond the president’s request.

If one is unhappy with our progress in Iraq after four years of war, voting to de-fund the war makes sense. If one is unhappy with the manner in which we went to war, without a constitutional declaration, voting against funding for that war makes equally good sense. What occurred, however, was the worst of both. Democrats, dissatisfied with the way the war is being fought, gave the president all the money he asked for and more to keep fighting it, while demanding that he fight it in the manner they see fit. That is definitely not a recipe for success in Iraq and foreign policy in general.

What is the best way forward in Iraq? Where do we go from here? First, Congress should admit its mistake in unconstitutionally transferring war power to the president and in citing United Nations resolutions as justification for war against Iraq. We should never go to war because another nation has violated a United Nations resolution. Then we should repeal the authority given to the president in 2002 and disavow presidential discretion in starting wars. Then we should start bringing our troops home in the safest manner possible.

Though many will criticize the president for mis-steps in Iraq and at home, it is with the willing participation of Congress, through measures like this war funding bill, that our policy continues to veer off course. Additionally, it is with the complicity of Congress that we have become a nation of pre-emptive war, secret military tribunals, torture, rejection of habeas corpus, warrantless searches, undue government secrecy, extraordinary renditions, and uncontrolled spying on the American people. Fighting over there has nothing to do with preserving freedoms here at home. More likely the opposite is true.
